Rent A House Terms and Conditions
These terms and conditions (“Terms”) govern the use of Rent A House’’s online platform for property rentals (“Platform”). By accessing or using the Platform, you agree to comply with these Terms. If you do not agree with any part of these Terms, you may not use our services.
Use of the Platform
a. Eligibility: Users must be at least 18 years old to use our services. By using the Platform, you confirm that you are of legal age.
b. Account Registration: Users may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Property Listings and Rentals
a. Property Listings: Property owners may list their properties for rent on the Platform. Rent A House is not responsible for the accuracy of the information provided by property owners and does not guarantee the availability, quality, or legality of listed properties unless they have been classified as verified properties.
b. Rental Agreements: Users renting properties through the Platform are subject to the terms and conditions set by the property owner or manager. Rent A House is not a party to any rental agreement and bears no responsibility for disputes between parties.
Lease Signing
a. Lease Agreements: When renting a property listed on the Platform, users may be required to sign a lease agreement with the property owner or manager. This agreement outlines the terms and conditions of the rental, including the duration, rent amount, security deposit, and other pertinent details.
b. Electronic Signatures: Users acknowledge and agree that electronic signatures and agreements made through the Platform constitute a legally binding contract between the parties involved in the rental transaction.
c. Responsibility: It is the responsibility of users to carefully review and understand the terms of the lease agreement before signing. Rent A House is not a party to these agreements and does not provide legal advice regarding their content.
d. Disputes: Any disputes or issues arising from the lease agreement shall be resolved between the parties involved. Rent A House bears no responsibility for disputes related to the terms of the lease agreement.
Non-Discrimination
a. Equal Opportunity: Rent A House promotes equal opportunity and does not tolerate discrimination based on race, color, ethnicity, national origin, religion, gender, sexual orientation, marital status, age, disability, or any other legally protected status.
b. Property Listings: Property owners and managers listing their properties on the Platform are required to comply with anti-discrimination laws and guidelines. They are prohibited from discriminating against potential renters based on any protected characteristics mentioned above.
c. User Conduct: Users of the Platform are expected to adhere to non-discriminatory practices when interacting with other users. Any discriminatory behavior or content on the Platform will result in immediate removal and potential legal action.
d. Reporting Discrimination: If users encounter any discriminatory practices or content on the Platform, they are encouraged to report it to Rent A House immediately for investigation.
e. Compliance with Laws: Rent A House complies with all applicable fair housing laws and regulations. Users are expected to comply with these laws in all their interactions on the Platform.
Fees and Payments
a. Service Fees: Rent A House may charge service fees for the use of the Platform. Fee details will be clearly outlined before completing any transaction.
b. Payments: Users agree to make payments as agreed upon with property owners. Rent A House may facilitate payment processing, but we are not responsible for any issues related to payments between parties.
User Conduct
a. Prohibited Activities: Users must not engage in any illegal, fraudulent, or unauthorized activities on the Platform. This includes but is not limited to spamming, hacking, or violating any laws or regulations.
b. Content Submission: Users are solely responsible for the content they submit on the Platform. Rent A House reserves the right to remove any content that violates these Terms.
Intellectual Property
a. Ownership: All content and materials on the Platform, unless otherwise stated, are the property of Rent A House and are protected by intellectual property laws.
Disclaimer and Limitation of Liability
a. Disclaimer: Rent A House does not warrant the accuracy, reliability, or completeness of information on the Platform. Users access and use the Platform at their own risk.
b. Limitation of Liability: Rent A House shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Platform.
Modification of Terms
a. Rent A House reserves the right to modify these Terms at any time. Users will be notified of changes, and continued use of the Platform after modifications constitutes acceptance of the updated Terms.
Governing Law and Dispute Resolution
a. These Terms are governed by the laws of South Africa. Any dispute arising from the use of the Platform shall be resolved through arbitration or mediation.
